TERMS AND CONDITIONS

1.            PRELIMINARY

1.             By using the Meet a Mining Man website (Website) you accept the following terms and conditions (Terms and Conditions) which are legally binding upon you. Your use of the Website constitutes your acceptance of the Terms and Conditions.

2.             The owner of the business known as Meet a Mining Man (Meet a Mining Man) may update, amend or add to the Terms and Conditions at any time. Any update, amendment or addition to the Terms and Conditions will appear on this page and is effective from the date that it is posted. A notification of any updates to the Terms and Conditions will be posted on the Website's discussion forum (Forum). Your continued use of the Website constitutes your acceptance of the updated Terms and Conditions.

3.             If any of the Terms or Conditions are deemed to be invalid in whole or in part, the remainder of the Terms and Conditions continue to operate in full.

7.             Meet a Mining Man is not responsible for any technical problems connected with the use of the Website, including but not limited to technical problems related to telephone networks, telephone lines, online computer systems, Internet servers or providers, computer equipment, software, Internet traffic congestion or associated services or equipment.

8.             Meet a Mining Man is not responsible for any error, omission, deletion, interruption or delay in the operation of the Website or the transmission of information via the Website.

9.             Meet a Mining Man is not responsible for the theft, destruction, alteration of, or unauthorised access to, any details, communications or information of users of the Website.

4.             Intellectual property

10.         Meet a Mining Man owns and retains proprietary rights in all the Meet a Mining Man intellectual property including copyrighted material, trademarks and business names (Intellectual Property).

11.         Meet a Mining Man has copyright in all material comprising the Website other than material posted by anyone other than Meet a Mining Man.

12.         You must not copy, modify, publish, transmit, distribute, display, link, frame, pass off, sell or otherwise use any of the Intellectual Property without the prior, written consent of Meet a Mining Man.

5.             ELIGIBILITY TO USE THE WEBSITE

13.         By using the Website you warrant that you:

(a)        are at least 18 years of age;

(b)        there are no laws that prohibit your use of the Website in the nation or region in which you use the Website;

(c)        if you participate in the Website's discussion forum (Forum) you will do so in a manner that respects other people and their right to self-determination in matters of a sexual nature;

(d)        you will not engage in conduct in using the Website that constitutes an offence in Western Australia or the nation or region in which you use the Website;

(e)        you will not engage in conduct in using the Website that is in breach of a law of Western Australia, the Commonwealth of Australia or the nation or region in which you use the Website;

(f)         you will not permit anyone under the age of 18 years to access the Website and will take reasonable steps to ensure that anyone under the age of 18 years cannot access the Website from your computer;

(g)        you will not permit anyone who is prohibited by law in the nation or region in which you use the website from using the Website to access the Website and will take reasonable steps to ensure that any such persons cannot access the Website from your computer;

(h)        you have not been convicted of a violent or sexually related criminal offence.

14.             Meet a Mining Man is not liable in respect of any content that is caused to be displayed on the Website by users of the Website.

15.         Meet a Mining Man does not guarantee or make any representations as to the veracity of any content that is caused to be displayed on the Website by users of the Website.

16.         You are solely responsible for any content that you cause to be displayed on the Website or transmit to any other user of the Website.

17.         Meet a Mining Man has the right to amend or delete any content displayed on the Website (including but not limited to profile information, photographs or messages) that Meet a Mining Man regards as inappropriate, offensive, illegal or contrary to the aims of the Website.

18.         You agree that you must:

(a)        not display anywhere on the Website any direct contact details (including email addresses, telephone numbers, message services) for yourself or any other person;

(b)        not display anywhere on the Website any form of illegal content, including but not limited to child pornography and depictions of bestiality;

(c)        not display anywhere on the Website any content that is reasonably regarded as racist, bigoted, threatening, abusive or in any other way offensive;

(d)        not transmit any spam, junk mail or chain letters to any other user of the Website;

(e)        not display anywhere on the Website any copyrighted material in which you do not own the copyright without the permission of the owner of the copyrighted material;

(f)         not create a false or misleading profile that is inaccurate in:

(i)          its description of you;

(ii)        your gender;

(iii)       your sexual orientation; or

(iv)       any other material aspect;

(g)        not create a profile for someone other than yourself;

(h)        not spread any computer virus or use any robot/spider or other automatic device or manual process to monitor or copy the Website in whole or in part without the written consent of Meet a Mining Man;

(i)          not promote any other website or business through the Website or otherwise; or

(j)          not advertise, promote or solicit other users of the Website to buy or sell any product or service through the Website.

19.         You are responsible for your interaction with other users of the Website.

20.         Meet a Mining Man is not liable in relation to any interaction between users of the Website whether that interaction occurs through the Website or otherwise.

21.         Meet a Mining Man does not control and is not liable for any information that is transmitted between users of the Website.

22.         You must use caution and act with regard to your personal safety when you use the Website.

23.         You are responsible for determining which 'Meet a Mining Man' membership package best suits your needs.

24.         Meet a Mining Man can change the 'Meet a Mining Man' membership packages and rates from time to time but the changes will not affect any current subscription that you may have to the Website.

25.         Payment for 'Meet a Mining Man' membership packages must be made by credit card and paid in advance in full for the duration of the membership package.

26.         Payment for 'Meet a Mining Man' membership packages are non-refundable and Meet a Mining Man will not accept payment on an incremental basis.

27.         If Meet a Mining Man terminates your membership package in accordance with the Terms and Conditions or as a result of your breach of the Terms and Conditions, you are not entitled to a refund, in whole or in part, for any amount paid to Meet a Mining Man for your membership package.

28.         If you terminate your membership package prior to its expiration, you are not entitled to a refund, in whole or in part, for any amount paid to Meet a Mining Man for your membership package.

29.         You are bound by the Terms and Conditions even after the termination of your Meet a Mining Man membership package.

30.         Meet a Mining Man expressly disclaims any warranty of the Website's fitness for a particular purpose.

31.         Meet a Mining Man does not guarantee that users of the Website will attain any specific results from the use of the Website.

32.         Meet a Mining Man is not liable to you any other entity for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including damages for loss of profit or personal injury arising out of your use of the Website, or the use of the Website by any other person, even if Meet a Mining Man has been advised of the possibility of such damages.

33.         Notwithstanding anything to the contrary contained in the Terms and Conditions, Meet a Mining Man's liability to you or any other entity, for any cause whatsoever and howsoever arising, regardless of the cause of action, is at all time limited to the amount paid, if any, by you to Meet a Mining Man for your use of the Website.

34.         You must indemnify Meet a Mining Man, its subsidiaries, affiliates, officers, agents and employees against all claims and all losses, liability, costs and expenses [including solicitor and client costs, the investigation, travel and living expenses of employees and witness fees] incurred by Meet a Mining Man arising from:

(a)        your use of the Website;

(b)        your interaction with Meet a Mining Man, its subsidiaries, affiliates, officers, agents and employees;

(c)        your interaction with other users of the Website; or

(d)        a breach by you of the Terms and Conditions or any other agreement between the you and Meet a Mining Man.

35.         Meet a Mining Man has the right to cancel your Meet a Mining Man membership without compensation or refund if Meet a Mining Man reasonably considers that you are in breach any of the Terms and Conditions.

36.         Any failure by Meet a Mining Man not to act upon a breach by you of the Terms and Conditions does not constitute a waiver of Meet a Mining Man's rights under these Terms or Conditions or otherwise at law and will not prevent Meet a Mining Man from acting upon any subsequent breach of the Terms and Conditions by you.

37.         Meet a Mining Man will assist any State or Federal authority if required by law and will provide any relevant details that it possesses if required to do so by law.
